In Wales, we don’t have to wait until mid February to show our affection to the one we love. Dydd Santes Dwynwen is considered to be the Welsh equivalent to Valentine’s Day and is celebrated on 25th of January every year. It celebrates Dwynwen, the Welsh saint of lovers.
The popularity and celebration of St Dwynwen’s day has increased considerably in recent years, with special events, such as concerts and parties, greetings cards and even national chain stores using it as an opportunity to sell heart shaped chocolates.
For some it will mean an even greater commitment, such as engagement or buying a house together. However, before getting lost in romance, it is worth considering some practical (if unromantic) legal tips too!
In England and Wales, pre-nups are not legally binding, and the courts have the power to overrule them, however recent cases have upheld pre-nups which have been properly entered into.
Particularly if one has more in the way of assets than the other it is worth thinking about.
Though it’s a morbid thought for newlyweds, it makes sense to plan for all eventualities. People often assume that if you live together you will automatically inherit everything, but that is not the case. You should also bear in mind that marriage automatically revokes (cancels) and existing Will.
Having a Will drawn up is inexpensive and can save a great deal of heartache and confusion further down the line.
Buying a property together is one of the most exciting things a couple can do, but before you get carried away constructing flat packed furniture, make sure you take clear legal advice on purchasing a property.
When you buy a property together, your individual shares of the ownership will usually be considered to be 50:50, irrespective of how much each of you puts towards the cost of buying the property. If you wish to have a different arrangement e.g. because one of you is contributing significantly more than the other, you will need to have your percentages of ownership specified in a legally binding document.
You may also consider a Cohabitation agreement, sometimes referred to as a ‘living together agreement’. It can give certainty over how you will handle the important issues related to your home. It can set out who pays for what, both during your relationship and if your relationship ends. This can save you time, money and a lot of stress, whilst also making it easier to maintain a positive relationship with your partner…no matter what happens.
We offer jargon free, specialist legal advice in all of these areas. Our award winning Family, Property and Wills and Probate teams can offer the advice you need on your contemplation of marriage, preparing a Will and buying a house.
Yng Nghymru, does dim rhaid i ni aros tan ganol Chwefror (Dydd San Ffolant) i ddangos ein hoffter tuag at yr un ryda ni yn ei garu neu ei charu!
Mae’n dathlu Dwynwen, sant cariadon Cymru. Mae poblogrwydd a dathliad diwrnod Santes Dwynwen wedi cynyddu’n sylweddol yn ystod y blynyddoedd diwethaf, gyda digwyddiadau arbennig, fel cyngherddau a phartïon, cardiau cyfarch, a hyd yn oed y siopau mawr cenedlaethol yn ei ystyried yn gyfle i werthu siocledi siâp calon. I rai, bydd yn golygu mwy o ymrwymiad, dyweddiad neu brynu tŷ gyda’i gilydd efallai.
Er ei bod yn hawdd ymgolli yn y rhamant mae’n werth ystyried rhai awgrymiadau ymarferol hefyd!
Mae gan y llysoedd yng Nghymru a Lloegr y pŵer i ddiystyru “pre-nups”, ond mae achosion diweddar wedi cadarnhau eu dilysrwydd, yn enwedig os ydych wedi ystyried o ddifrif goblygiadau y cytundeb ac yn llwyr ymwybodol o’r hyn yr ydych yn ei arwyddo.
Mae’n werth meddwl amdano, yn enwedig os oes gan un fwy o ran asedau na’r llall.
Er ei bod yn forbid i feddwl am farwolaeth, mae angen cynllunio ar gyfer y dyfodol. Mae pobl yn aml dybio y byddwch chi’n etifeddu popeth yn awtomatig, ar farwolaeth partner, ond nid yw hynny’n wir. Mae llunio ewyllys yn rhad ac yn gallu arbed torcalon a dryswch yn y dyfodol.
Mae prynu tŷ gyda dyweddi neu bartner yn un o’r pethau mwyaf cyffrous y gall cwpl ei wneud.
Ond cyn i chi fynd ati i adeiladu dodrefn pecyn fflat IKEA, gwnewch yn siŵr fodd bynnag eich bod yn cael cyngor cyfreithiol clir ar brynu eiddo, yn enwedig os yw un parti yn cyfrannu blaendal mwy na’r llall.
Pan fyddwch chi’n prynu eiddo gyda’ch gilydd, er gwaethaf maint eich cyfraniad unigol, bydd eich perchnogaeth o’r eiddo hwnnw, yn cael ei ystyried yn gyfartal. Os nad dyna yw’r trefniant e.e. efallai bod un ohonoch yn cyfrannu maint sydd yn llawer fwy sylweddol na’r llall, bydd angen ichi gofnodi hynny mewn dogfen gyfreithiol.
Gall ‘cytundeb cyd-fyw’ sicrhau heddwch meddwl a hynny oherwydd bydd yn nodi sut y byddwch yn delio â’r materion pwysig sy’n gysylltiedig â’ch cartref; gall nodi pwy sydd yn talu am be’, a beth ddylai ddigwydd os bydd yn berthynas yn darfod.
Gall hyn arbed amser, arian a llawer o straen i chi, tra hefyd yn ei gwneud hi’n haws cynnal perthynas gadarnhaol â’ch partner.
