Rough Sex Defence and the Domestic Abuse Bill

Our specialist family law solicitor Leah Rhydderch appeared on the Post Cyntaf BBC Radio Cymru on 6 July 2020, discussing the new clause that will be added to the Domestic Abuse Bill that will end the so- called “rough sex defence”. The new bill, covering England and Wales, is due to become law later this year.
Leah discussed that the amendment would rule out “consent for sexual gratification” as a defence for causing serious harm, in England and Wales court proceedings. This new amendment is a “milestone” in ending violence against women as it will invalidate any courtroom defence of consent in cases where a victim suffers serious harm or is killed.
The current law says that if someone kills another person during sexual activity they could be charged with manslaughter alone, while to murder someone, there needs to have been an intention to kill that person or to cause them grievous bodily harm (GBH).

Leah said that this change is significant in the battle to challenge male violence against women. No death or serious injury will be able to be defended by rough sex gone wrong.

Roedd Leah yn trafod y byddai’r cymal ychwanegol yn diystyru’r amddiffyniad “rhyw treisgar”/ “boddhad rhywiol” fel amddiffyniad i gyhuddiad o niwed difrifol neu lofruddiaeth.

Dywedodd bod hyn yn “garreg filltir” wrth daclo trais yn erbyn menywod a hynny oherwydd na fydd modd defnyddio’r amddiffyniad mewn achos o ddioddef niwed difrifol neu lofruddiaeth.

Yn ôl y gyfraith bresennol, os bydd rhywun yn lladd rhywun arall yn ystod gweithgaredd rhywiol, cânt eu cyhuddo o ddynladdiad; yn wahanol i llofruddiaeth lle mae rhaid bod bwriad i ladd yr unigolyn hwnnw neu achosi niwed corfforol difrifol iddo (GBH).

Dywedodd Leah fod y newid hwn yn sylweddol yn y frwydr i herio trais dynion yn erbyn menywod. Ni fydd modd defnyddio’r amddiffyniad mai “rhyw wedi mynd i’i le” achosodd y farwolaeth ne anaf ddifrifol.

COVID-19 

We are delighted to announce that our offices are now open to the public  between 10am and 4pm Monday to Friday, by appointment.

We will continue to provide our services remotely outside those hours so that you will be able to contact us between 8.3oam and 5pm.

We have followed Welsh Government guidance to allow us to open our doors safely. We have hand sanitisers, PPE, protective screens and are enforcing  two metre spacing. We have also limited the numbers allowed in our buildings by operating a rota of those office working and those working remotely.
