Disease litigation involves claims where an illness or medical condition has been caused, or made worse, by exposure to harmful substances or unsafe conditions — often in the workplace or as a result of long-term exposure.

These cases can be complex and may relate to exposure that occurred many years ago. Establishing a link between the illness and exposure requires specialist legal knowledge and medical evidence, which is why early advice is important.

A disease caused by exposure or unsafe working conditions can affect every aspect of your life. You may be dealing with physical symptoms, emotional distress, financial pressure or concerns about the future.

We will assess your claim at an initial free interview and we will explain the options to fund your claim, which include the possibility of legal expenses insurance via your home contents insurance policy or a No win, No fee* agreement, in appropriate cases.

* ‘No win no fee‘ means that we will act under a Conditional Fee Agreement. Under this agreement you will not pay our legal fees if your claim is unsuccessful, and if your claim succeeds you will pay a success fee which we will explain clearly and in writing before you decide to proceed. However, there are circumstances where you may still have to pay costs whether you win or lose. These can include paying disbursements (expenses) such as medical report fees, court fees, or payments to experts. We will recommend taking out an After‑the‑Event insurance policy, if you do not have existing cover, and you will be required to pay the premium for the policy in the event of a successful claim, depending on the policy terms. There are also situations where substantial costs can arise, for example, if you decide to stop your claim part‑way through, in which case you may be charged for work already carried out on an hourly rate; if third‑party costs have been incurred on your behalf; or, in rare cases, if the claim is not managed properly, it could result in you being liable for the other party’s costs. All terms, risks and potential charges will be set out clearly in your Conditional Fee Agreement, and we will ensure you fully understand the funding arrangement so that you can make an informed decision.
