In Wales there have been fundamental changes to the way that patients’ concerns about the Health Service are handled, with the introduction of the NHS Redress measure which came into force on the 01 April 2011.
 
The new arrangements known as “Putting Things Right” are designed to deal with both complaints and a legal claim where compensation falls below £25,000.00. The arrangements apply to the NHS and to GPs in relation to complaints, although only to the NHS in terms of payment of compensation.
 
A complaint must be noted within twelve months of the treatment which is the subject of complaint. The NHS is responsible for the investigation of its own actions and are to involve the person who notified the complaint in the investigation. The investigation may include obtaining independent medical evidence or advice.
 
If harm has been caused then the NHS are under a duty to consider whether a liability to pay compensation exists, or may exist and if such harm has occurred then the NHS has a duty to consider Redress.
 
Redress is the formal name for the provision for the NHS to offer compensation up to £25,000.00 for any harm caused.
 
The new regulations within Wales can be very useful tool for patients who have suffered a medical accident dependant upon the nature of the claim and any injury caused.
 
There now exists in Wales two methods for injured patients to advance potential claims. This being the “Putting Things Right” procedure; or alternatively a claim for damages for compensation for medical negligence in the usual manner.
