TOUGHER PENALTIES FOR SPEEDING MOTORISTS
Plans have been announced to increase the fixed penalty to £100 and six points for what are described as “excessive speeders.” Excessive speeders could be motorists travelling at 15 mph above a 30 mph limit or excess of 90 mph on a motorway. The plans have drawn mixed responses as motorists could face a disqualification of six months for as little as two speeding offences.
In reality however it could be argued that the plans will make little difference. At present the police have discretion as to whether to offer motorists the option of a fixed penalty for speeding and so the worst offences of speeding inevitably result in a court appearance. Equally motorists have a discretion as to whether to accept a fixed penalty if it is offered, or not.
The Courts have sentencing guidelines to follow when dealing with speeding offences, allowing a wide discretion. The penalties can range from three penalty points up to instant disqualification together with increased fines.
If the planned increased fixed penalties are brought in then we may find that many motorists are prepared to take their chances and attend court in the hope of avoiding them. Particularly motorists travelling at just above the 90 mph limit on a deserted motorway for example. It therefore remains to be seen whether the plans, if implemented, prove to be effective and make any real difference.
